These terms cover using this website and hiring The Verv Co. to design, build or look after your website. We've written them in plain English.

the short version
- Every project starts with a written quote. If your quote or contract says something different from this page, the quote or contract is what counts.
- We ask for half the price (a 50% deposit) before we start, and the rest before your site goes live.
- Once you've paid in full, the design and content we made for your site belong to you.
- For 30 days after launch, we fix problems caused by our work for free.
- These terms follow the laws of Jamaica.
1.about these terms
These terms apply when you use this website and when you hire The Verv Co. ("we" or "us") to design, build or look after a website or other project. By using this website or accepting a quote from us, you agree to these terms.
If your signed quote, proposal or contract says something different, that document takes priority for your project. When these terms say "in writing", an email counts.
2.using this website
You're welcome to look around this website and share links to it. Please don't try to break it, overload it, copy it as your own or use it for anything illegal.
We try to keep everything here accurate, but it's a general description of what we do, not a formal offer. The details in your quote are what you can rely on.
This website links to other websites, such as SPARK, Behance and Instagram. We don't control those websites, so we're not responsible for what's on them or how they handle your information.
3.who owns what on this site
The design, words, code and logo on this website belong to The Verv Co. The projects in our work section belong to their owners and are shown with permission, and work by a named designer is credited to them. Please ask us before you reuse anything from this site.
4.quotes
Before any work starts, we send you a written quote. It sets out what we'll do, the price and the timeline. A quote is valid for 30 days unless it says otherwise.
If you want something that isn't in your quote, like extra pages or features, we'll price it separately first. We won't start any extra work until you say yes.
5.payments
- You pay a 50% deposit before we start. You pay the rest before your site goes live, or before we hand over the final files.
- Invoices are due within 14 days unless your quote says otherwise.
- Support & care plans are paid monthly, at the start of each month.
- Prices are in the currency shown on your quote.
If a payment is late, we may pause work until it's paid, and your launch date may move back.
6.your part in the project
To keep things on schedule, we need you to:
- Send us your content, such as text, photos, logos and product details, by the dates we agree
- Give feedback and approvals within the times set out in your quote
- Make sure everything you send us is accurate and that you have the right to use it
- Tell us about any legal or industry rules your site has to follow
If content or feedback comes in late, the launch date moves back too.
7.changes to the design
Your quote includes two rounds of changes to the design. Once you approve the design, we start building.
Changes after you've approved the design, or extra rounds of changes, cost extra. We'll either price them separately or charge our hourly rate.
8.other companies' services and costs
Most websites rely on services from other companies. These include your web address (domain), web hosting, online store systems, payment providers, add-ons (plugins), fonts and stock photos. Unless your quote includes them, you pay for these yourself, either directly or by paying us back.
Each of these companies has its own terms. We're not responsible if their service goes down or if they change their prices or rules. Where we can, we set up these accounts in your name so you stay in control of them.
9.who owns your finished site
Once you've paid in full:
- You own the final design, words and graphics we made just for your site.
- Some of our code and tools get reused across many projects. You get permanent permission (a licence) to use them as part of your site.
- Things from other companies, such as fonts, photos and plugins, stay under their own licences.
Until you've paid in full, the work still belongs to us.
10.showing your project
We may show finished projects on our website and social media, and when we pitch to new clients. If your project needs to stay private, tell us in writing and we won't show it publicly.
11.after your site goes live
For 30 days after launch, we fix problems caused by our work for free. This doesn't cover changes made by you or anyone else, problems caused by other companies' updates or services, or new features.
After those 30 days, fixes and changes are covered by a support & care plan, or we'll give you a price for them.
12.support & care plans
A support & care plan covers the updates, fixes and small changes listed in your plan. Plans run month to month. To cancel, tell us in writing at least 30 days ahead.
13.cancelling a project
You can cancel a project at any time by telling us in writing. You pay for the work we've done up to that point. Once work has started, the deposit can't be refunded.
If we don't hear from you for 60 days during a project, we may close it and invoice you for the work done so far. We can start again later with a new timeline.
We may end a project if a payment is very late, or if we're asked to do something illegal. If that happens, we'll tell you in writing and only charge for the work done.
14.keeping things private
We keep your business information private, and we only use the access you give us to your accounts for your project. Our privacy policy explains how we handle personal information.
15.what we're responsible for
We take care with every project, but no one can promise that a website will always work perfectly. We also can't promise results, such as a top spot on Google or a certain number of sales.
As far as the law allows, the most we would ever have to pay you for a problem with a project is the amount you paid us for that project. We're also not responsible for indirect losses, such as lost profits or lost data.
Some rights under Jamaica's consumer laws can't be removed by any agreement. Nothing in these terms affects those rights.
16.the law that applies
These terms follow the laws of Jamaica, and any legal dispute will be handled by the courts of Jamaica. If something goes wrong, please talk to us first. Most problems can be sorted out quickly.
17.changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. The version in place when you accepted your quote is the one that applies to your project.
